These terms of use (the "Terms of Use") govern the use of perception.al (the "Service"). This Service is owned and operated by Peak Studios Software Inc.. This Service is a website and mobile application.

By using this Service, you indicate that you have read and understand these Terms of Use and agree to abide by them at all times.

Intellectual Property
All content published and made available on our Service is the property of Peak Studios Software Inc. and the Service’s creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Service.

Acceptable Use
As a user of our Service, you agree to use our Service legally, not to use our Service for illegal purposes, and not to:

Harass or mistreat other users of our Service;
Violate the rights of other users of our Service;
Violate the intellectual property rights of the Service owners or any third party to the Service;
Act in any way that could be considered fraudulent;
Post any material that may be deemed inappropriate or offensive;
Misuse any "unlimited" aspects of the platform in a manner that is inconsistent with the intended purpose and fair use policy, including but not limited to, excessive consumption of resources that negatively impacts the service for other users;
Exploit the platform's artificial intelligence and generative capabilities for unethical purposes, including the creation of deceptive, misleading, or harmful content.; or
Attempting to decompile, reverse engineer, or otherwise disassemble any portion of the platform, including its underlying software, architecture, or other proprietary information.

If we believe you are using our Service illegally or in a manner that violates these Terms of Use, we reserve the right to limit, suspend or terminate your access to our Service. We also reserve the right to take steps necessary to prevent you from accessing our Service.

Accounts
When you create an account on our Service, you agree to the following:

You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and
All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.

We reserve the right to suspend or terminate your account if you are using our Service illegally or if you violate these Terms of Use.

Sale of Services
These Terms of Use govern the sale of services available on our Service, such as subscription to our Service.

The subscription will be paid for in full when the services are ordered, unless indicated otherwise by free trials of our Service. Refer to the Free Trial section for more information.

These Terms of Use apply to all the services that are displayed on our Service at the time you access it. All information, descriptions, or images that we provide about our services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all services we provide. You agree to purchase services from our Service at your own risk. We reserve the right to modify, reject or cancel your order whenever it becomes necessary.

Subscriptions
Your subscription automatically renews and you will be automatically billed until we receive notification that you want to cancel the subscription.

To cancel your subscription, please follow these steps: Log in to your account and select "Manage Subscription" under the "Plan & Payment" tab.

Upon initiation of a subscription cancellation request, it is hereby understood and agreed that no refunds shall be issued for any remaining period of the subscription term. The subscription shall remain active and accessible until the conclusion of the current billing cycle. Following the cessation of the active subscription term, access to the account and its services may be either entirely restricted or limited to a read-only mode for a designated period.

It is the responsibility of the User to ensure that all necessary data and information are secured prior to the termination of the subscription term, as the Service shall not be liable for any loss of data or information post-cancellation.

Free Trial
We offer the following free trial of our services: Under some subscription plans, a limited free trial period begins when the User registers for a new account.

At the end of your free trial, the following will occur: At the end of the free trial, the User will automatically be billed our monthly subscription rate. If you do not want to be billed, you will need to cancel your subscription prior to the end of the free trial period.

To cancel your free trial, please follow these steps: Log in to your account and select "Manage Subscription" under the "Plan & Payment" tab.

Payments
We accept the following payment methods on our Service:

Credit Card;
Apple Pay;
Google Pay;
Link; and,
Other linked payment methods through Stripe, a payment service provider.

When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms of Use, we reserve the right to cancel or reverse your transaction.

Consumer Protection Law
Where the Business Practice and Consumer Protection Act, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms of Use will not limit your legal rights and remedies under that legislation. These Terms of Use will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms of Use and that legislation, the mandatory provisions of the legislation will apply.

Our Service contains links to third party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third party website or service linked to on our Service. It is your responsibility to read the terms and conditions and privacy policies of these third party websites before using these sites.

Limitation of Liability
PEAK STUDIOS SOFTWARE INC. AND OUR DIRECTORS, OFFICERS, AGENTS, EMPLOYEES, SUBSIDIARIES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY ACTIONS, CLAIMS, LOSSES, DAMAGES, LIABILITIES AND EXPENSES INCLUDING LEGAL FEES FROM YOUR USE OF THE SERVICE.

Indemnity
EXCEPT WHERE PROHIBITED BY LAW, BY USING THIS SERVICE YOU INDEMNIFY AND HOLD HARMLESS PEAK STUDIOS SOFTWARE INC. AND OUR DIRECTORS, OFFICERS, AGENTS, EMPLOYEES, SUBSIDIARIES, AND AFFILIATES FROM ANY ACTIONS, CLAIMS, LOSSES, DAMAGES, LIABILITIES AND EXPENSES INCLUDING LEGAL FEES ARISING OUT OF YOUR USE OF OUR SERVICE OR YOUR VIOLATION OF THESE TERMS OF USE.

Applicable Law
These Terms of Use are governed by the laws of the Province of British Columbia.

Severability
If at any time any of the provisions set forth in these Terms of Use are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms of Use. All other provisions will not be affected by the removal and the rest of these Terms of Use will still be considered valid.

Changes
These Terms of Use may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Service and the way we expect users to behave on our Service. We will notify users by email of changes to these Terms of Use or post a notice on our Service.
